Terms of Service

These Terms of Service (“Terms”) govern your use of the PROppeal app and website (the “Service”). By using the Service, you agree to these Terms. If you don’t agree, please don’t use the Service.

1. What PROppeal does

PROppeal helps you assemble a comparable-sales-backed property tax appeal letter and evidence summary that you review, sign, and file yourself with your taxing authority. We provide the tool and the supporting data; the decision to file, and the filing itself, are yours.

2. Not professional advice

PROppeal is not a law firm, tax advisor, or licensed appraiser, and using it does not create any professional or fiduciary relationship. The comparable sales we surface come from third-party data and are not a certified appraisal. Property-tax rules, deadlines, and outcomes vary by jurisdiction. You are responsible for confirming what applies to you.

3. Eligibility

You must be at least 18 years old and able to form a binding contract. The Service is offered for U.S. residential property.

4. Your responsibilities

• Provide accurate information about your property.
• Verify all data and figures with your county before filing — including comparable sales, assessed values, and deadlines.
• You are solely responsible for filing your appeal, meeting all deadlines, and the content you submit. PROppeal does not file for you and does not guarantee any deadline.

5. Credits and purchases

• Some features require credits purchased through Apple. Purchases are subject to Apple’s terms, and refunds are handled by Apple.
• Credits are consumable, tied to your account, and have no cash value.
• Gifting credits, where offered, may be subject to limits we set. We may change features and pricing over time.

6. Data accuracy

Property and comparable-sales data is sourced from third parties and may be incomplete, out of date, or inaccurate. Estimates and valuations are not appraisals. We screen comps for quality, but you must verify everything before relying on it.

7. Acceptable use

Don’t misuse the Service: no reverse-engineering, scraping, reselling, interfering with its operation, infringing others’ rights, or submitting unlawful content.

8. Your content

You keep ownership of the information, photos, and signature you provide (“Your Content”). You grant us a limited license to use Your Content to operate and provide the Service — including sending it to the property-data and AI providers described in our Privacy Policy. You represent that you have the rights to submit Your Content.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR THAT ANY APPEAL WILL SUCCEED.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROPPEAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOST SAVINGS OR MISSED DEADLINES. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US $50.

11. Indemnification

You agree to indemnify and hold PROppeal harmless from claims arising out of your misuse of the Service or your violation of these Terms.

12. Changes & termination

We may modify the Service or these Terms. We’ll update the “Last updated” date, and material changes will be communicated where appropriate. Continued use after changes means you accept them. We may suspend or end access for violations of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Nebraska, without regard to its conflict-of-laws rules.
